The ILO Governing Body will consider using its constitutional powers to refer violations to the International Court of Justice, or take other actions to ensure the recommendations of the Commission of Inquiry into violations in Myanmar are fully and promptly implemented. The GB directed the Director General to prepare a report on potential measures that can be taken, including using the powers under article 29 of the ILO constitution (which allow for matters to be referred to the ICJ), for discussion at the March 2024 meeting.

The referral happened in record time after the Myanmar military made it clear it had no intention to cease its war against workers. PSI assisted with the Commission of Inquiry.

PSI welcomes the referral and will encourage the GB to use all measures available to ensure compliance with the recommendations, including referral to the ICJ and the use of sanctions against the military. The PSI Congress adopted a resolution on Myanmar (p. 38).
